These Terms of Service govern your use of mergencekc.com, Mergence Relay, and other software and services provided by Mergence LLC ("Mergence," "we," "us"), 10701 E 343rd St, Drexel, MO 64742. By using our services you agree to these Terms.

Our services

Mergence provides forward-deployed engineering and software, including Mergence Relay, a field-capture and notification tool used by our clients' staff. Access may require an account provided by Mergence or your employer.

Acceptable use

You agree not to misuse our services, interfere with their operation, access them without authorization, or use them to violate any law.

Mergence Relay SMS notifications

Program name: Mergence Relay Alerts.

Program description: When you opt in, Mergence LLC sends text messages with account notifications, task and status alerts, and service updates related to your use of Mergence Relay. We do not send marketing messages through this program.

How to opt in: Enter your mobile number on the Mergence Relay SMS sign-up page or in your Relay account settings and check the consent box. Consent is not a condition of purchase or of using our services.

Message frequency varies based on your account activity.

Message and data rates may apply.

To stop receiving messages, reply STOP at any time. You will receive one final confirmation message and no further messages unless you opt in again.

Carriers are not liable for delayed or undelivered messages.

Your mobile information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Intellectual property

Mergence and its licensors own the services and all related software, content, and trademarks. Client data remains the property of the client.

Disclaimers

Our services are provided "as is" without warranties of any kind, to the extent permitted by law.

Limitation of liability

To the extent permitted by law, Mergence is not liable for indirect, incidental, or consequential damages arising from your use of the services.

Changes and termination

We may update these Terms or suspend access to the services at any time. Continued use after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Missouri.
